“I had an exceptionally difficult medical malpractice case against a nursing home involving the death of a 67 year-old woman on coumadin. My client suffered a chronic subdural hematoma, after a minor fall, and passed away after 2 ½ months. As the plaintiff’s counsel, our position was that the patient suffered a very slow brain bleed, and while she did not exhibit symptoms, the nursing home having been aware of the fall and her condition, still should have transferred her to a hospital for a CT scan of the brain sooner. In discussions with CMI, Paula Franklin suggested a computer animation with scrolling dates, showing the increasing severity of the subdural bleed and how it can take a great deal of time to deteriorate. CMI also created medical illustrations on posterboard enhancing the bleed and the mid-line shift of the brain. After summations in a two-week jury trial, the jurors sent a note asking to view the animation and the posterboard. The jury rendered a $ 10 million dollar verdict for the estate. Speaking with the jurors afterwards, they commented that the CMI illustration and animation were critical to their understanding of the complicated medicine.
